Terms of Service

These terms govern your use of the Shopify app Capyo: AI Product Photos Bulk and this website. Installing the app means you accept them. They sit alongside Shopify's own terms for app usage, which continue to apply.

1. Who you are contracting with

Capyo, operated by an individual developer ("we", "us"). Contact: gimbernat13@gmail.com.

"You" means the merchant that installs the app — the Shopify store owner, and anyone you authorise to use the app in your admin.

2. What the service does

Capyo generates product photos in bulk. You choose a selection — a collection, a tag, a search or your whole catalog — and one mode: a styled scene, a clean white background, or the product on an on-model preset. For each product the app reads the featured image, calls the image provider for that mode, and stores the result in your shop's Files. The first four products are generated as a preview before the rest of the run is charged to; you confirm or cancel after seeing them. When a run finishes you publish the outputs as new media — optionally setting one as the featured image, adding alt text and applying a square crop — or let runs publish automatically if you have that setting on.

Outputs are appended, never substituted. Capyo adds new media next to your existing images; it never replaces, resizes, recolors, reorders or deletes the source image (except to move the new image to the featured slot when you ask). Every run keeps a snapshot of what publishing changed, so a run — or one product in it — can be undone while the snapshot is inside its retention window: 30 days on Free and Starter, 90 days on Growth and Pro.

What it does not do: it does not read your orders or customers, edit your theme, add anything to your storefront, or accept uploaded models in this version. It makes no claim about how closely a generated image resembles a studio photograph. It generates images from the model presets and prompts it supports, and it can only read a product's featured image.

3. Plans, billing and credits

One credit per output in every mode, previews included. A failed output is refunded automatically, so you are never charged for an image you did not receive. Credits reset at the start of each billing cycle and do not roll over. There is no overage in this version: a run is limited to the credits you have. A custom scene prompt is available from Growth; "HD" outputs on the premium engine cost two credits.

Shopify bills you, not us. Plans run on Shopify's Managed Pricing: the charge appears on your Shopify invoice, and Shopify's rules on proration, taxes and refunds apply. Prices are in USD and exclude any taxes Shopify adds. Annual billing is not offered yet.

Downgrading keeps your data. A run that is already in progress finishes; undo retention for new runs follows the new plan. Uninstalling stops future charges at the end of the current billing period.

We may change prices for new billing periods; we will tell you in the app before a change affects you.

4. Your images, your responsibility

You own the images the app generates for your products, and you are responsible for what you publish. Capyo generates images from your source images with the mode and preset you choose; it does not review them for accuracy, lawfulness or suitability, and it does not publish anything you did not ask it to publish. You are responsible for the images that appear on your storefront and for any rights they may engage.

Model presets are synthetic. The people in the on-model presets are generated by the app's own pipeline and labelled as such in the Models screen. They do not depict real people, and they are not photographs of anyone. This version does not let you upload your own model.

The app makes no claim about how closely an output resembles a studio photograph, and it does not promise that publishing an image will produce any particular sales, conversion or revenue outcome. Nothing in the app, on this website or in a support reply is a guarantee or prediction of any commercial result.

5. Your responsibilities and acceptable use

We may suspend an installation that breaches this section, and will tell you why.

6. Availability and support

We run the service on a best-effort basis. There is no service level agreement on any plan, and none at all on Free. Maintenance, hosting incidents, Shopify platform outages or a change on an image provider's side can delay a run. A failed item is retried on a short backoff and then marked failed and refunded; a provider's safety refusal is surfaced as a failed, refunded item rather than retried forever. A failed file upload is retried and then surfaced with the reason.

7. Intellectual property

The app, its code, its interface, its prompt and preset library, and this website belong to us. Your store data, your source images, and the images the app generates for your products belong to you. The model presets are the app's synthetic assets and remain ours; you get a licence to use the outputs that contain them on your own storefront.

8. Liability

The service is provided "as is". To the fullest extent permitted by law, our total liability arising out of or in connection with these terms is limited to the fees you actually paid for the app in the twelve months before the event giving rise to the claim. On the Free plan, that amount is zero.

We are not liable for indirect or consequential loss, lost profit, lost sales, loss of data, the content of an image you published, a decision you made based on a generated image, or the failure of an image provider to generate an output.

Nothing here excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud, and for intent or gross negligence.

9. Termination

You can uninstall at any time, from your Shopify admin, without giving a reason. Uninstalling ends this agreement, stops future billing at the end of the current period, cancels your scheduled jobs, and starts the deletion described in the Privacy Policy. We may terminate an installation for a material breach of section 5, or if we discontinue the app — in which case we will give notice in the app first.

10. Changes to these terms

We may update these terms. The current version is always the one on this page, with its date at the top. Material changes are announced in the app before they take effect. Continuing to use the app after that means you accept the new version; if you do not, uninstall.

11. Governing law

These terms are governed by the laws of the operator's country of establishment. Mandatory consumer and merchant protections of your own country remain unaffected.
