Terms of Service

These terms govern your use of the Shopify app Capyo: Accessibility WCAG EAA and this website. Installing the app means you accept them. They sit alongside Shopify's own terms for app usage, which continue to apply.

1. Who you are contracting with

Capyo, operated by an individual developer ("we", "us"). Contact: gimbernat13@gmail.com.

"You" means the merchant that installs the app — the Shopify store owner, and anyone you authorise to use the app in your admin.

2. What the service does

Capyo scans the storefront pages in your page set with axe-core in a headless browser and reports the findings against WCAG 2.1 AA / EN 301 549, grouped by rule or by page and filterable by impact. It offers a catalog of nine code-level fixes that are applied at runtime by a theme app extension (an app embed) you enable in the theme editor: six safe fixes are on by default and three riskier fixes — a contrast override, a reduced-motion rule and a body-font swap — are off. A fix can be previewed on your own storefront with a short-lived token, applied, and reverted with one click. The app generates AI alt text for product images, queued for your per-image accept, edit or reject, and writes only accepted values to Shopify. It produces a dated Prüfbericht PDF per scan on a paid plan and generates the content of an accessibility statement, published by the app at its own URL on your domain.

Nothing renders on your storefront until you enable the app embed. What it does not do: it does not write to your theme code, it does not scan or alter checkout, it does not load any third-party overlay script, and it does not read your customers or orders. It makes no claim about how closely its findings or documents match any authority's own assessment.

3. Plans, trials and billing

Shopify bills you, not us. Plans run on Shopify's Managed Pricing: the charge appears on your Shopify invoice, and Shopify's rules on trials, proration, taxes and refunds apply. A trial converts to the paid plan at the end of the trial period unless you cancel first. Prices are in USD and exclude any taxes Shopify adds. Annual billing is not offered yet.

The alt-text allowance resets on your subscription's cycle, not on the calendar month. If a provider errors or returns empty text, that item consumes no allowance. If the allowance is exhausted mid-job, queued items stay pending and the screen shows exactly how many are left and when the allowance resets; there is no partial silent stop.

Downgrading to Free keeps your data: risky fixes are turned off, safe fixes remain live only on the first 5 page-set entries, the scan cadence becomes weekly, regression emails stop, PDFs already generated stay downloadable, and alt text already written to Shopify stays in Shopify. Nothing is deleted by a downgrade.

We may change prices for new billing periods; we will tell you in the app before a change affects you.

It does not decide whether your store or any page conforms to the European Accessibility Act, the BFSG, EN 301 549 or any other law, and it cannot be used as a substitute for a legal assessment. 5. Your responsibilities and acceptable use

We may suspend an installation that breaches this section, and will tell you why.

6. Availability and support

We run the service on a best-effort basis. There is no service level agreement on any plan, and none at all on Free. Maintenance, hosting incidents, Shopify platform outages or a change on an image provider's side can delay a scan or an alt job. A page that times out in a scan is recorded with a reason, never dropped silently, and a failed alt item is retried on a short backoff and then marked failed without consuming your allowance. A store behind a password page is reported as blocked with an explanation rather than given invented findings.

7. Intellectual property

The app, its code, its interface, its fix catalog and rule text, and this website belong to us. Your store data, your product images, the generated alt text, your reports and your published statement belong to you. The accessibility statement is a template generated for you; you may edit and publish it freely.

8. Liability

The service is provided "as is". To the fullest extent permitted by law, our total liability arising out of or in connection with these terms is limited to the fees you actually paid for the app in the twelve months before the event giving rise to the claim. On the Free plan, that amount is zero.

We are not liable for indirect or consequential loss, lost profit, lost sales, loss of data, a legal outcome or the absence of one, an authority's or a court's assessment of your store, or a decision you made on the basis of a finding, a score or a generated document.

Nothing here excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud, and for intent or gross negligence.

9. Termination

You can uninstall at any time, from your Shopify admin, without giving a reason. Uninstalling ends this agreement, stops future billing at the end of the current period, cancels your scheduled jobs, makes the statement URL return 404 immediately, and starts the deletion described in the Privacy Policy. Alt text already written to your product media stays in Shopify. We may terminate an installation for a material breach of section 5, or if we discontinue the app — in which case we will give notice in the app first.

10. Changes to these terms

We may update these terms. The current version is always the one on this page, with its date at the top. Material changes are announced in the app before they take effect. Continuing to use the app after that means you accept the new version; if you do not, uninstall.

11. Governing law

These terms are governed by the laws of the operator's country of establishment. Mandatory consumer and merchant protections of your own country remain unaffected.
